A contract to sell refers to a contract of agreement between a seller and a buyer. This contract and legal document will state that the seller agrees and promises to sell a property to the buyer and that the buyer is promising to purchase said property from the seller. 

This contract will have all the terms and conditions required for the sale. This document is also required by banks or financial institutions before they can process your home loan.

However, even when signed by both buyer and seller and notarized by a lawyer, this contract does not automatically grant ownership to the buyer. Only after the buyer pays for the property in full will they be given the Deed of Absolute Sale showing the transfer in ownership and rights.

The following details must be present in this real estate form: full name and address of the seller, full name and address of the buyer, address and land area of the property, price of sale, price for down payment, the terms and conditions of payment and delivery, signatures from both parties, and a notarized seal.

Letter of Intent to Replace Buyer or Lessee

When you are in the middle of buying or paying of your purchased houses, sometimes unforeseen situations can force you to sell the property before you are finished paying the totality of your mortgage. Often, you are purchasing the home with help from a bank loan or a loan from other financial institutions such as Pag-IBIG. If for some reason circumstances dictate the need for transferring the home loan or lease to a new owner, you will need to submit to your loan provider a Letter of Intent to Replace Buyer or Lessee.

When property owners pass away, ownership of their properties will transfer to their heirs.
