Contract to Sell Sample Form

A contract to sell refers to a contract of agreement between a seller and a buyer. This contract and legal document will state that the seller agrees and promises to sell a property to the buyer and that the buyer is promising to purchase said property from the seller. 

This contract will have all the terms and conditions required for the sale. This document is also required by banks or financial institutions before they can process your home loan.

However, even when signed by both buyer and seller and notarized by a lawyer, this contract does not automatically grant ownership to the buyer. Only after the buyer pays for the property in full will they be given the Deed of Absolute Sale showing the transfer in ownership and rights.

The following details must be present in this real estate form: full name and address of the seller, full name and address of the buyer, address and land area of the property, price of sale, price for down payment, the terms and conditions of payment and delivery, signatures from both parties, and a notarized seal.

Conditional Contract to Sell Sample Form

A Conditional Contract to Sell is a real estate form that details a real estate transaction that is subject to various conditions. Often, the seller will allow the buyer to take delivery of the property and have them pay for it in full at a later date. Rightful ownership of the property remains with the seller until the property is fully paid.

This type of contract outlines the conditional terms of the transaction, including deposit, delivery, payment terms, when the full payment is expected, and conditions. This contract will also outline what the seller and buyer are allowed to do when the conditions of the sale are not met, or when the buyer defaults.

Contracts of this type should be specific and must include the following details: property type, downpayment, payment terms, duration, interest rates, delivery, conditions upon buyer default, and conditions for repossession by the seller.

Sample Form for Contract of Lease

Whether you are renting a luxury condo or a luxury house and lot in the Philippines, you will need to provide a contract of lease. If you rent out properties as a real estate business, then this real estate form serves as a guide for a smooth landlord and tenant relationship.

A contract of lease binds two parties, the landlord and tenant, into a rental agreement. This lease contract specifies the tenant’s right to live and occupy the property and the landlord’s right to retain ownership. This contract will contain tenant information and other contract information including essential lease information such as property description, security deposit, rental amount, payment terms, duration of lease, maintenance responsibilities, and other additional contract terms and conditions.

The contract of lease should also specify the rights and obligations of landlord and tenant, conditions for lease termination, renewal or cancellation, as well as legal remedies when it comes to rental disputes.

Deed of Absolute Sale Sample Form

A luxury real estate purchase is considered complete once you are given the Deed of Absolute Sale. Real estate forms like this one signify the legal transfer of property rights and complete ownership from the seller to the buyer. This document states that the buyer owns the property unconditionally and that the seller will no longer have any claim to the property.

Typically, this legal document is given only after the buyer has paid for the luxury real estate property in full. An independent surveyor will assess the current market value of the property to determine the property taxes and other fees that the owner will shoulder.

Letter of Intent to Replace Buyer or Lessee

When you are in the middle of buying or paying of your purchased houses, sometimes unforeseen situations can force you to sell the property before you are finished paying the totality of your mortgage. Often, you are purchasing the home with help from a bank loan or a loan from other financial institutions such as Pag-IBIG. If for some reason circumstances dictate the need for transferring the home loan or lease to a new owner, you will need to submit to your loan provider a Letter of Intent to Replace Buyer or Lessee. 

Lending institutions require this notarized letter that states the name of the original buyer/lessee, property address, certificate title number, remaining balance, and monthly payment amount. This letter of intent should also state an agreement to the previously set terms and conditions between the original buyer/lessee and the lending institution. Depending on the real estate business loan manager and real estate agent, you might also need to submit further documentation and other real estate forms.

Notice of Death Sample Real Estate Forms

When property owners pass away, ownership of their properties will transfer to their heirs. However, a transaction such as the transferring of ownership upon death is not as straightforward as one would assume. As with all luxury real estate transactions, this entails a legal process that should be done as soon as possible to avoid penalties or additional fees.

The Notice of Death informs relevant offices and authorities regarding the death of property owners. This notice must include the name of the decedent, their age, the name of their spouse, and the date they passed away. This notice should also include how you are related to the decedent. 

The notice of death must be submitted by the heirs to their Revenue District Office to begin the processing of the estate taxes and transfer of property.

Sample Prenuptial Agreement Form

A prenuptial agreement is a legal document and contract that is arranged by two individuals prior to their marriage. This type of contract will outline how their assets, finances, and other important matters are to be handled in the event of a divorce or separation. A prenuptial agreement can also provide clear guidelines that will help protect family inheritance, financial rights, address alimony, integrate business interests, company organization, and not to mention provide peace of mind for the couple and their families.
